These Terms and Conditions ("Terms") govern your use of EyeInspo ("the App"), provided by Ingenious Inspiration - Philipp Schofield ("Company," "we," "us," or "our"). By accessing or using the App, you agree to abide by these Terms. If you do not agree with these Terms, please do not use the App.
By using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please discontinue your use of the App immediately.
a. You may use the App for your personal, non-commercial use only. Any other use of the App is strictly prohibited.
b. You agree not to use the App in any way that may:
i. Violate any applicable laws, regulations, or third-party rights. ii. Disrupt, disable, or impair the functionality of the App. iii. Collect or harvest any information from other users of the App. iv. Transmit any viruses or malicious code.
a. All content and materials available on the App, including but not limited to text, graphics, images, logos, and software, are the property of the Company or its licensors and are protected by copyright and other intellectual property laws.
b. You may not reproduce, modify, distribute, or create derivative works from any content on the App without our prior written consent. You are allowed to share the generated images and videos from the App.
a. We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of the App or any content or services therein, (ii) any bugs, viruses, Trojan horses, or the like, which may be transmitted to or through the App by any third party, or (iii) any errors or omissions in any content or services or for any loss or damage of any kind incurred as a result of your use of any content or services posted, emailed, transmitted, or otherwise made available via the App, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
b. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your personal information as described in the Privacy Policy.
Our app offers in-app purchases that allow users to acquire virtual goods or premium features to enhance their experience within the app. These in-app purchases may include but are not limited to digital eye makeup palettes. Our in-app purchases are for in-app use only.
The pricing for in-app purchases is clearly displayed within the app and is subject to change at our discretion. Users are responsible for any charges incurred through their respective app store accounts when making in-app purchases, including any applicable taxes.
Refund requests for in-app purchases will be considered on a case-by-case basis. Users may contact our support team at support@eyeinspo.app to request a refund and provide details regarding the purchase and the reason for the refund request.
i. Purchased virtual goods or premium features will be delivered and made available to users within the app according to the app's functionality.
ii. Some in-app purchases may have expiration dates or limitations on their use, which will be clearly communicated within the app.
Users are solely responsible for managing their in-app purchases, including payments, cancellations, refunds, and compliance with app store terms and conditions.
Users acknowledge and agree that in-app purchases are subject to the terms and conditions of the app store through which they made the purchase, including but not limited to the Apple App Store and Google Play Store. Users are responsible for complying with these store-specific terms.
We reserve the right to terminate or suspend your access to the App at our discretion, without notice, for any reason, including if you violate these Terms.
We may update these Terms at any time, and any changes will be effective upon posting. You are responsible for regularly reviewing these Terms for updates.
